General Terms:

  • YOU HAVE THREE DAYS TO PAY! Unless otherwise mutually agreed to in writing - If you are in need of a payment extension you must first inquire with the auctioneer whether that be for financing or any other reasons.

  • Payment Cut Off: Payments due by Friday December 22nd by 2 PM

  • Cash, Wire, Credit Card, Certified Check, E-Check, Personal/Business Check (special hold terms), Money Order

  • Cards: American Express, MasterCard, Discover, Visa

  • No Dollar Amount Limit on Credit Cards - Buyers will be required to sign an acceptance of goods agreement

  • No title/document fees charged from the auction company - be prepared to pay any state required title transfer fees

  • Allow ample amount of time for receipt of title after payment (approx. 14-30 days)

  • Notary services available - handled between the seller and buyer, auctioneer will help facilitate

  • No open titles given

  • Applicable 6% PA State Sales Tax May Apply - Bid accordingly - In accordance with PA Tax Code certain items may be subject to and others exempt. For example, certain farming, forestry, and manufacturing equipment may not be subject to depending on specific end use. . Assume there is sales tax due unless otherwise notified or you or the item falls under the categories listed below.

  • Re-sellers regularly in the business of buying and selling will need to provide the proper re sales number, certificate or proper documentation.

  • Auction company does not collect sales tax on titled items such as trucks and trailers; “road” vehicles, if applicable, the buyer is responsible to pay any sales/transfer tax that may apply at the time of title transfer or the appropriate time.

  • "Farmer” and other “end use” exemptions are accepted on applicable items. Individuals, farmers, companies depending on end use may be able to claim an exemption. Please be prepared to sign a "tax exemption release" document if you plan to make certain exemption claims.

  • Tax Exempt Certificates: You must provide us with a copy of your PA Sales Tax Exempt Certificate or provide the proper information/documentation to not be charged. Please provide us with this at your earliest convenance.

  • Exporters: If you take possession within the United States, you must pay applicable PA Sales Tax. You must provide a Bill of Lading to not be charged. Export purchases must be removed by a freight company. The freight company must provide a Bill of Lading with the items properly listed.

  • Out of state buyers: There is no sales tax charged for buyers who can prove their residence or place of business is located “out of state”.

REGISTRATION: In order to bid in the auction you must create a ProxiBid account, if you don’t have one already, register for this specific auction when prompted and then complete the deposit requirement. Once these steps are completed you will be approved to bid in the auction and could start bidding immediately. To start the registration process, click the button listed above “View All Lots and Bid Now” this will take you to the auction catalog through ProxiBid. This is where all bidding takes place. Click on the button at the top right that says “SIGN IN,” you will be prompted to either sign in or sign up and create a new account. Complete ProxiBid’s requirements and create a ProxiBid account. Then register for this specific auction when prompted or attempt to bid in the auction and it will prompt you to register. You will be placed into pending status. Then complete the bidding deposit as described below, you will be taken to a secure site to submit your bidding deposit. Once we get notified of the completion of these steps you will be approved and could start bidding.

BIDDING DEPOSIT: Deposit may be required to bid - watch emails. Use the “Buy Now” button below to pay the $500 deposit to bid in this 2023 Year-End Equipment Auction. If no purchase is made, a full refund is immediately processed following the auction for the full $500 bidding deposit amount.  If a purchase is made, the deposit may be applied to your balance at the completion of the auction. If you do not want the deposit applied to your balance, simply let us know once you receive your invoice following the auction.

GENERAL AUCTION TERMS:

MAKE CERTAIN TO CAREFULLY READ THE GENERAL TERMS AND CONDITIONS BELOW AND MORE SPECIFICALLY THE DETAILED TERMS WHEN ACTUALLY REGISTERING TO BID

Removal/Pickup: Once payment and any payment hold requirements have been met and invoices are “Paid In Full” buyer may pick up their items at the specified times or by anointment. All items must be removed within 30 days following the auctions end date and time. All items not removed by the required date of Thursday January 18th 2023 will incur a $500 removal fee, due immediately at that time. Furthermore items are then subject to storage fees that could be up to $100 usd a day. If the buyer continues to not remove their items in accordance with the terms and a period of 10 days passes, Buyer completely forfeits the not removed items to the auctioneer and are still subject to the incurred fees.

Local Hauling/Trucking: Hauling is available within 200 miles of the auction site for a fixed fee of $250 plus a $3.00 X Mile fee. Please use the form below to request shipping or contact our office to inquire. Freight is offered by one of the sellers in the auction.

All property offered "AS-IS" with no contingencies. On all titled vehicles guaranteeing a marketable and insurable title free and clear of liens.

Buyers Premium (BP) Applies: 10% of the high bid amount will be added to the high bid amount to achieve the total purchase price. This is how the final purchase price is calculated. 

Example: (high bid amount, amount due at closing) $50,000 + $5,000 (buyers premium) = $55,000 (total purchase price)

ALL BIDS ARE FINAL: By registering for the auction, submitting bid/s and/or ultimately the final winning bid you are entering into a legal and binding contract. If your bid is the final winning bid at the “fall of the hammer” and/or timed close of the online bidding it is considered a legal and binding contract in accordance with Pennsylvania State Auction Law. The winning bidder is subject to all terms and conditions of the auction. Furthermore the buyer is required as clearly stated to deliver a deposit at the time of registration in order to bid, If the buyer fails to abide by the terms and conditions they agreed to, and fails to pay their invoice in full within the required time period or within a time period mutuallyu agreed to between the auctioneers and buyers in writing, the buyer risks loosing their deposit and risks being prosecuted to the fullest extent of the law and furthermore all monies owed by the buyer to Dynamic Auction Group/Realty, LLC and/or the Seller are still due and are subject to collections.

PAYMENT: The successful/winning online buyer must make immediate payment arrangements. You can pay through an invoice sent to your email if paying by card or E-check, or the buyer must make arrangements with the auctioneer to pay in physical cash or check (see check info below) or buyer must make arrangements with their financial institution to make an immediate electronic wire transfer or money order for the full invoice amount. Payment must be delivered or scheduled no later than 2 PM the Friday after the auctions end date, Friday, December 22nd, 2023 by 2 PM. Any other payment arrangements to be valid must be mutually agreed to between the buyer and auctioneer and placed into writing prior to Friday, December 22nd, 2023 by 2 PM.

CHECKS: Unless certified all other checks will be subject to a removal hold. If paying by check you will not be able to pick up your items until the check has cleared and auctioneer has formally notified you in writing that you may pick up your items and that the hold has been removed. This may take 1-5 days depending on the banking institutions.

Notice: At the request of the auctioneer online bidders must be available to communicate with the auctioneers either through telephone or a messaging service leading up to the auction's end time if they need to communicate with you for whatever reasons. Failure to communicate with the auctioneers at their request could result in the decline of your registration and bids.

Independent Legal Advice: Bidder/Buyer hereby acknowledges that they have had the opportunity to obtain independent legal advice and confirms by the execution of submitting a bid that they have done so or waived their right to do so in connection with entering into this auction, and its bidding process, and its terms and conditions.

DUE DILIGENCE: If you are a buyer that will be seeking financing or will need inspections in order to purchase, please start that process as soon as possible in order to be prepared for the auction. As mentioned, there are no contingencies, including but not limited to: No financing contingency, No inspection contingency, No appraisal contingency. However, financing and inspections are permitted, your commitment and responsibility to pay your invoice in full is NOT contingent upon those items. Do your due diligence, ask questions, and be prepared to bid and buy in confidence.
